Leo Antonio Rodriguez, who is charged with attempting to elude a police vehicle, appeared for a motion hearing to grant 96 days credit. The order was dismissed without prejudice because Rodriguez has already served a 12-month sentence.

She was originally sentenced to 29.75 months confinement and 29.75 months of community custody for the above charge, possession of a controlled substance and second-degree burglary. The state requested the court grant the motion to change the sentence to 12.75 months custody and 12.75 months community custody, citing a recent state Supreme Court ruling that statue RCW 69.50.4014(1) regarding possession of a controlled substance is unconstitutional. The court ruled Hernandez’s previous convictions won’t count and she’ll be re-sentenced at a May 4 hearing.
