Criminal Sentencing

Arthur L. Palmer, 34, of Billings, Mont., pleaded guilty July 30 to attempting to elude a pursuing police vehicle in connection with a Nov. 15, 2016, incident affecting at least two Davenport businesses. In exchange for his plea, prosecutors withdrew a charge of third-degree possession of stolen property. His sentence includes three months electronic home monitoring in Montana and payment of $700 in court assessments.

Civil Judgments

Jesse Quinn Balm, doing business as The Tree Whisperer, of Edwall, must pay $4,201.41 in workers compensation obligations to the Washington State Department of Labor and Industries.

A default judgment for quiet title on property in Sec. 9, T21N, R33E, was granted July 30 to Michael McAuliffe, personal representative of the estate of Donna Kittilson, against respondents Jared T. Caudill, Aric B. (Erik) Frank, Harley Frank, Justin G. Harrison, Selena Kennedy (Selena M. Frank), Coire J. Kittilson, Mark A. Wagner, Robert R. Wagner, Randall J. Wagner, and 100 other individuals. No monetary award was involved.

Explaining that a preponderance of the evidence did not support the petitioner’s claim of non-consensual sexual contact or penetration, the court on June 25 denied Davenport resident Gattie-Johanna Belzak’s request for a sexual assault protection order against Steve A. Belzak. The petitioner filed an appeal on Aug. 2 with the state Court of Appeals, Division III.

New Criminal Cases

Nathan L. Pierce, 29, of Vancouver, Wash., is charged with second-degree identity theft in connection with a single-vehicle collision on Interstate 90 near Sprague on May 24. Pierce is accused of providing a name other than his own to the investigating Washington State Patrol trooper.

Matayo A. Matta-McDougall, 20, of Spokane, is charged with attempted second-degree intentional murder or, in the alternative, first-degree assault with a firearm or deadly weapon in connection with a July 24 domestic violence incident in Wilbur. He is also charged with first-degree unlawful possession of a firearm, and attempting to elude a pursuing police vehicle. He is alleged to have fired a weapon at a woman inside a vehicle parked outside a Wilbur business.

New Juvenile Offender Matters

A 15-year-old Odessa boy and a 13-year-old Spokane boy are charged with second-degree malicious mischief in connection with a June 24 incident involving the spray-painting of two vehicles with black paint in the 200 block of West 1st Street in Odessa and the discharge of fire extinguishers and vandalism to heavy equipment in the Lincoln County Public Works facility in Odessa.

New Civil Case

Hartford Accident and Indemnity Co. seeks a $25,595.16 judgment against Allen J. Nichols in a matter involving a June 3, 2017, two-vehicle collision in Lincoln County that resulted in damage to a vehicle driven by Justin Smith.

Danielle Jo Hopper, Reardan – probation violation (driving while license suspended), 3 days jail converted to 24 hours community service.

Marlie Lyman Rose, Harrington – probation violation (driving while license suspended), 5 days jail converted to 40 hours community service.
