Council amends code concerning unruly animals

Owners of animals causing damages to property will be liable once municipal code is updated

DAVENPORT—An owner of a pet will soon be liable for damages caused to other’s property by that pet in city limits, city council declared in a unanimous decision at council’s meeting Wednesday, Sept. 14.

Council approved an ordinance amending the city municipal code by adding Chapter 8.06, which will say that the owner of any unruly pet that causes damages to fences or other personal property will be liable, according to a state RCW.

Any owner of animals legal to own as pets under city code who allow damage to property shall be “deemed guilty” and “shall be punishable as provided” under the municipal code and state RCW.

Councilmember Cory Hollis, who has been council’s most outspoken voice on the issue of unruly animals in city limits, said the updated code language reflects state laws.

The code language brought to council originally stated “fences” instead of “property,” but council agreed to change the language at its meeting.

The code will be updated once the amendment is legally advertised.

Pets legal to own in city limits that could reasonably cause property damage if left unchecked include dogs, cats, goats, horses, mules, cows, calves, sheep and swine.

Council also approved the first reading of a resolution allowing the city to sublease its hangar at the municipal airport to Todd Vercoe of Medical Lake through the end of 2022.

Other resolutions approved included adopting right-of-way procedures for the second phase of a pathway through the city near Highway 25 and setting a public hearing on Oct. 12 to vacate the south 20 feet of Sinclair Street from 10th to 11th Street and Lot One, Block 61 of Essig’s Addition per the request of Jim Buchanan.
