Magruder found guilty of escape

Man sentenced to 73 months in prison

DAVENPORT - A 37-year-old Carlton man pleaded guilty Tuesday to aiding in the assault of a Lincoln County Jail dispatch/corrections officer and escaping from the jail last August.

Cody James Magruder entered a guilty plea on two counts of custodial assault, one count of second-degree robbery, two counts of second-degree escape and one count of first-degree malicious mischief in Lincoln County Superior Court Tuesday, March 7.

Magruder was sentenced to 73 months in prison concurrent with a separate sentence he received after being found guilty of second-degree burglary in November.

He told presiding judge Lech Radzimski of Stevens County that his escape, which occurred after fellow inmate Damion Pegram allegedly broke Deputy Dave Husky's arm with a fire extinguisher Monday, Aug. 22, was a "spur of the moment" action.

Radzimski disagreed.

"What strikes is this was a brazen incident that affected the whole community," Radzimski said. "I doubt this happened spur of the moment."

Magruder didn't go far in his escape attempt, which forced a countywide manhunt and caused extracurricular activities to be shut down at the local schools.

He was captured by deputies after apparently spending the night in a wheat field just south of the city Tuesday, Aug. 23.

"I want to apologize to Officer Husky," Magruder said after his sentence was handed down. "It was spur of the moment on my end. Complete stupidity."

After Magruder serves his 73 months in prison, he must serve 12 months in community custody. He was ordered to pay restitution for the damage he caused to Lincoln County Jail in the escape.

Pegram, meanwhile, has a trial start date of May 31.
