Court Report

SUPERIOR COURT

John F. Strohmaier, Judge

Criminal Sentencings

Timothy Albert Evenson, 31, pleaded guilty April 9 to third-degree escape in connection with his failure to report on Jan. 2 to begin serving four months in jail, part of his sentence for second-degree trafficking in stolen property that was handed down Nov. 27, 2018. As a result of a plea agreement with prosecutors, the charge was amended from bail-jumping. Ten days of jail were added to his four-month sentence, along with $700 court costs and 12 months probation.

Doyle Anthony Gabriel, 50, of Davenport, pleaded guilty April 2 to first-degree assault in connection with a Sept. 6, 2018, incident during which Lincoln County Sheriff’s Deputy Chad Cunningham used deadly force in firing four shots into the engine block of a pickup truck driven by Gabriel to prevent it from ramming a patrol vehicle on Cayuse Cove Road near Davenport. Gabriel was tasered twice in an effort to complete the arrest. As a result of a plea agreement with prosecutors, a charge of attempting to elude a pursuing patrol vehicle was withdrawn. Earlier, he had pleaded not guilty due to insanity, but in deciding to change his plea to guilty, he wrote that he “didn’t mean to hurt” the deputy but acknowledged “a substantial likelihood” the jury would not agree with that. His sentence includes 48 months in prison, 36 months probation and payment of $600 court assessments.
