Second lawsuit levied against Inland Power

DAVENPORT—A second group is blaming Inland Power for damages caused in the Whitney Road Fire in Sept. 2020. David and Kristine Hubbard filed a complaint in Lincoln County Superior Court Aug. 12 accusing the company of negligence in maintaining a downed powerline blamed for the fire’s start.

The Hubbards, who operate a cattle breeding and selling business called KD Piedmontese, lost miles of fencing, a barn, outhouses, 33 cows and grass pastures for cattle feeding in the fire. The family had to sell nearly 80% of their cattle after the fire, court documents state.

“As a direct and proximate cause of Inland Power’s negligence, the Plaintiffs suffered property loss and loss of profits in an amount to be proven at trial,” the court filing alleges.

The request for relief doesn’t specify an exact amount, saying relief and interest will be decided at trial.

A group consisting of Susan L. Bird, Terry L. Hoffman and Cole Ranch, LLC filed a complaint against Inland Power in July.

Local firefighters have said the Whitney Road Fire was started by a tree falling into power lines and ignited when a car crashed into the two felled lines.
